These Terms & Conditions (“Terms”) govern your use of the Site and any purchase, hire, or service booking made through it. By accessing the Site, placing an order, or booking a service, you agree to be bound by these Terms. These Terms apply in addition to any specific terms that apply to individual products, services, promotions, or hire agreements.

Macfarlane Generators is committed to providing exceptional customer service and quality products. We endeavour to make sure that all products listed on the Site are correctly described, currently in stock, and priced accurately. We recommend contacting us on 1300 622 436 to confirm pricing and suitability for your needs before purchase, especially for higher-value or specification-critical items.

We are a supplier and, in many cases, a distributor of generators and related equipment rather than the manufacturer. Where we pass on information provided to us by manufacturers (such as specifications, outputs, or warranty terms), we rely on that information being accurate and cannot independently verify every detail.

No Unlawful or Prohibited Use

As a condition of using the Site, you agree that you will not use it for any purpose that is unlawful or prohibited by these Terms. You must not use the Site in any way that could damage, disable, overburden, or impair it, or interfere with any other person's use and enjoyment of the Site. You must not attempt to access any part of the Site that is not intentionally made available to the public.

Products, Descriptions & Pricing

We aim to ensure that product descriptions, specifications, and images on the Site are accurate and current. However, specifications may change without notice (including manufacturer updates).

All prices are shown in Australian dollars (AUD) and include GST unless stated otherwise. We reserve the right to correct pricing errors at any time, including after an order has been placed; in that case we will contact you before proceeding and you may cancel the order for a full refund.

Some products are listed as Price on Application (POA). These items are not available for direct online purchase and require you to contact us or request a quote for current pricing and availability.

Orders & Payment

Placing an order through the Site is an offer to purchase, which we may accept or decline (for example, due to stock unavailability, pricing errors, or suspected fraud). A contract is formed only once we confirm your order.

Payment is required in full at the time of order unless otherwise agreed in writing (for example, for approved trade or finance accounts). We accept the payment methods displayed at checkout.

Finance options, where available, are provided by a third-party finance provider. Any finance arrangement is a separate agreement between you and that provider, and is subject to their own terms and credit approval.

Cancellation of Orders

We reserve the right to cancel an order at any time before delivery, for reasons that may include:

(a) our suppliers are unable to supply goods they had previously agreed to supply;

(b) an event beyond our control — such as storm, fire, flood, power failure, or failure of computer systems — means we are unable to supply the goods within a reasonable time;

(c) the goods ordered were subject to an error on the Site, for example in relation to description, price, or image, which was not discovered prior to the order being accepted; or

(d) you ask us to cancel your order.

Where we cancel an order after it has been accepted, we will notify you by email. If an order is cancelled by either party after payment has been processed, we will refund any money paid in respect of that order.

Shipping & Delivery

Delivery costs are calculated at checkout based on product weight and delivery location, and are shown before payment. Estimated transit times are provided in good faith but are not guaranteed.

For deliveries to remote or regional locations, additional freight costs may apply beyond what is shown at checkout. Where this occurs, we will contact you to advise of the additional cost before proceeding; if this is not to your satisfaction, we will cancel and refund the order.

Some larger or freight-arranged items are delivered by separate arrangement; in these cases we will contact you directly to organise delivery. Risk in the goods passes to you on delivery, or on collection if you choose Click & Collect. Full details are available on our Shipping, Returns & Warranty page.

Click & Collect

Where available, you may choose to collect your order from one of our branch locations. You will be notified when your order is ready for collection. Please bring confirmation of your order and valid identification when collecting.

Generator Hire

Hire of generators and related equipment is subject to a separate hire agreement, which will set out the hire period, delivery/collection arrangements, bond or security requirements (if any), fuel and consumables responsibility, and liability for loss or damage to hired equipment during the hire period. Where these Terms and a hire agreement conflict in relation to a hire booking, the hire agreement takes precedence.

Returns, Refunds & Australian Consumer Law

Nothing in these Terms is intended to circumvent the requirements of the Australian Consumer Law (ACL). Our goods and services come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Manufacturer & Macfarlane Warranties

On manufacturer-supplied equipment (for example, Cummins, Pramac, PowerLink, and others), the relevant manufacturer's own warranty conditions apply; Macfarlane Generators supports these where required by the manufacturer.

Macfarlane Generators also provides its own warranty on its products, services, and workmanship for 12 months or 2,000 hours (whichever comes first) from the date of shipment or invoice, under normal use and service. Alterations or repairs made without our prior approval may void this warranty. This warranty does not cover fair wear and tear, or damage caused by accident, abuse, misuse, neglect, or failure to observe proper operating or maintenance instructions. No warranty is given or implied on pre-owned equipment unless specified in writing at the point of sale.

To claim a warranty, a Warranty Return Authorisation (WRA) must be completed, along with a copy of the purchase invoice, and returned to us prior to any work being considered or authorised. Disclaimer and Limitation of Liability

Nothing in these Terms is intended to limit your rights under the Australian Consumer Law.

As noted above, we are a supplier of products and, for many items, rely upon information provided to us by manufacturers. Although we make our best endeavours to provide accurate and up-to-date information on the Site, by email, live chat, or over the phone, we cannot guarantee that all such information is free of errors or omissions.

To the maximum extent permitted by law, and subject to your rights under the Australian Consumer Law, our liability for any claim arising from your use of the Site or purchase of products or services is limited, at our option, to the replacement or repair of goods, the resupply of services, or the cost of doing so. To the maximum extent permitted by law, we are not liable for any indirect, special, or consequential loss (including loss of profits or business interruption) arising from your use of the Site or our products or services.

Indemnity

You agree to indemnify Macfarlane Generators against any claim, loss, or damage arising from your misuse of the Site, breach of these Terms, or breach of any applicable law.

Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Site, you consent to the handling of your information as described in that policy.

Changes to These Terms

We may update these Terms from time to time to reflect changes in our business practices or legal requirements. The current version will always be available on this page, with the “last updated” date shown above. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms or your use of the Site are subject to the non-exclusive jurisdiction of the courts of Victoria.
